New York is discriminating against fat African-Americans.
And not only fat African-Americans, but fat Hispanics and fat women in general.

The NAACP‘s New York state branch and the Hispanic Federation have joined beverage makers and sellers in trying to stop the rule from taking effect March 12. Critics are attacking what they call an inconsistent and undemocratic regulation, while city officials and health experts defend it as a pioneering and proper move to fight obesity.
The issue is complex for the minority advocates, especially given that obesity rates are higher than average among blacks and Hispanics, according to the federal Centers for Disease Control and Prevention. The groups say in court papers they’re concerned about the discrepancy, but the soda rule will unduly harm minority businesses and “freedom of choice in low-income communities.”
Evidently, African-Americans and Hispanics are over-represented among obese Americans. According to the Food Research and Action Center:
Recent national data show that 82.1 percent of Black women and 75.7 percent of Hispanic women are overweight or obese compared to 59.5 percent of White women (Flegal et al., 2012). In addition, over half of Black women are obese (versus 38.8 percent of Black men and 32.2 percent of White women) (Flegal et al., 2012). Extreme obesity continues to be higher among women (8.1 percent) than men (4.4 percent), especially among Black women who have more than double the rates of extreme obesity as White and Hispanic women (17.8 percent versus 7.1 percent and 6.0 percent) (Flegal et al., 2012). Rates of overweight or obesity are higher for Hispanic men (81.7 percent) compared to Black men (69.9 percent) and White men (74.0 percent), although obesity rates are fairly similar across racial-ethnic groups (Flegal et al., 2012).
This sort of naked prejudice towards our “fluffy” friends is outrageous. It cannot be tolerated. Fortunately, there is a proven solution to the problem. Change the standards. It works great in the school systems. We now are able to graduate kids from high school who are able to read at a fourth-grade level. So, the charge of racial discrimination in schools (by virtue of lower graduation rates) has been obviated – just as many minorities graduate on time as whites. Problem solved.
So, if the government merely adjusted the acceptable BMI standard to, oh say, 50%, the problem would go away and we could all be happy again. Then the NAACP and the Hispanic Federation could dedicate themselves to rooting out discrimination in more important areas – like any sort of criticism of President Obama – or any other African-American for that matter.
